Benji Cervera, 4, begged for food and water. He took food out of a trash can. It was on video taken in the weeks leading up to his death, and a Bexar County jury watched the footage Monday in the trial of the boy’s father, Brandon Cervera , 31. Prosecutors say Cervera purposely withheld food and water from Benjamin “ Benji ” Cervera, who died Aug. 17, 2021. The father is charged with injury to a child causing serious bodily injury, a first degree felony.
Benji’s aunt asked her brother: ‘Why was he looking for more food if he was being fed? ’ Detectives who investigated Benji’s death collected numerous videos of the boy from household cameras. One showed him crying in his bedroom for water and milk, with the door closed. In others, he was picking what appeared to be an empty snack bag out of a trash can, rummaging for food in the kitchen and taking different food items from the fridge and cabinets while no one else is visible.
Medical examiner doubles down on ruling: 4-year-old Benji starved to death Molina previously testified that she used Benji’s medical records, documents provided by forensic investigators, evidence from the San Antonio Police Department and medical publications to make her determination. She used that data to create a chart that displayed Benji’s growth over time. Soyars challenged the accuracy of the weights and measurements used in Molina’s chart.
