Shortly after, the Court of Appeals made plans for a last-minute hearing Wednesday morning on a stay pending appeal and thereafter voted 2-1 to dissolve the administrative stay they had issued, meaning SB 4 was blocked once again. In Wednesday morning's hearing, some of the justices appeared skeptical of some of the provisions of SB 4 but have yet to make any decision.
"Like watching a tennis match, the ball goes back and forth across the net constantly," Gov. Greg Abbott said in his first public comments since the developments at a keynote address with the Texas Public Policy Foundation. "Even without SB 4, Texas has the legal authority to arrest people coming across the razor wire barriers on our border, and we will continue to use our arrest authority and arrest people coming across the border illegally.
"I think folks were very much caught by surprise yesterday when it went into effect," Rep. Erin Zwiener, D-Driftwood, said. "And that's why we saw law enforcement agencies around the state trying to quickly reassure folks that just because this law went into effect didn't mean that every single law enforcement officer was going to be trying to look for folks who may or may not be in the country with proper documentation.
