Paramedic Peter Cichuniec, convicted for his role in Elijah McClain’s death sits, in court before his sentencing on Friday, March 1, 2024 in Brighton, Colo. Cichuniec was sentenced to five years in prison for the death of McClain in a rare prosecution of medical responders that has left officials rethinking how they treat people in police custody.
after Cichuniec spends at least 119 days in prison and after the Colorado Department of Corrections assesses Cichuniec’s risk level and reports back to the judge, which have both happened.Prosecutors with Colorado Attorney General Phil Weiser’s office opposed Cichuniec’s request, writing in a court filing that lowering Cichuniec’s sentence would be against the interests of justice.
“His statements on the stand during trial and at sentencing still reflect his unwavering belief that he has done nothing criminal,” the attorney general’s filing read. “The jury disagreed.”. Two other Aurora police officers, Jason Rosenblatt and Nathan Woodyard, were acquitted by juries of all criminal charges in McClain’s death.
