The latest disciplinary action follows new complaints that she hasn’t followed the orders of the Alabama Court of the Judiciary.
Under state rules, once a judge is charged by the Judicial Inquiry Commission they are automatically suspended with pay until their case adjudicated.The ordeal began in April 2021 when the commission filed a scathing 100-plus page complaint against Todd - Canon 2A: A judge should respect and comply with the law and should conduct at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.
- Canon 3C: A judge should disqualify in a proceeding in which disqualification is required by law or his impartiality might reasonably be questioned.Because Todd had already been off the bench for eight months, with pay, since April 2021, she was reinstated to the bench effective Dec. 6, 2021, and ordered to serve without pay for three months.
The complaint indicates that although Todd has said she was returning to work, she in fact did not log into Alacourt, an online case docketing and tracking system, between Dec. 6 and March 10. On Feb. 5, the complaint states, Todd emailed judges French and Streety, asking them to provide statements regarding her cooperation and compliance with the court’s order for return to work on Dec. 6.
