An Arizona judge rejected the arguments of two conservative groups that sued to stop a successful voter initiative requiring disclosure of campaign"dark money" and dismissed the case., Maricopa County Superior Court Judge M. Scott McCoy left only a narrow opening for the Center for Arizona Policy and Arizona Free Enterprise Club to convince him of their arguments, giving them until July 7 to file an amended complaint based on a long-shot legal theory.
Before the election, opponents of the measure tried and failed to stop it from appearing on the ballot. Voters subsequently approved While disclosures of donors may lead to a reduction in donations, they're also a means of"curbing the evils of campaign ignorance," the ruling states. While prior court cases have ruled that exceptions to transparency laws could happen if a plaintiff proves a"substantial number" of groups would face harassment or reprisals, those wouldn't work because in this case because only two organizations would face burdens, the judge wrote.
Goddard noted that the Center for Arizona Policy has argued for an expanded definition of the Constitution's privacy clause in this case, but has argued for more narrow interpretations of the clause in its court actions seeking to quash abortion rights.
