The federal government is allowed to hold on to the 2020 election ballots from Georgia's Fulton County that the FBI seized from a warehouse in Atlanta.

by MARIA TEDESCO | The National News DeskThe federal government is allowed to hold on to the 2020 election ballots from Georgia's Fulton County that the FBI seized from a warehouse in Atlanta, a judge ruled Wednesday.

Although Fulton County Lawyers argued that ballots and election materials should be returned, a judge ruled that the county did not meet the high legal bar for the court to intervene to get back the documents. In the 2020 presidential race, Georgia's votes were counted thrice and by hand. Each count confirmed that Joe Biden won the election. Although U.S. District Judge J.P.

Boulee wrote “the seizure in this case was certainly not perfect,” the DOJ did not disregard the county's rights. During the seizure, which occurred on Jan. 28, the federal government took possession of over 600 boxes of ballots and electronic records. Lawyers for Fulton County argued that the seizure was improper and unconstitutional.

The Department of Justice said they were investigating “irregularities that occurred during the 2020 presidential election in the County" and identified two laws that might have been broken. One law required election records to be maintained for 22 months. The other prohibits procuring, casting or tabulating false, fictitious or fraudulent ballots. The DOJ gave Fulton County copies of the document and the judge argued they would not be harmed if the documents were never returned.
