A judge on Tuesday set a $150,000 bond for a Mobile man accused of selling fentanyl that ultimate caused a Semmes teenager to suffer a fatal overdose.

Deandrea Deshawn Brown, 37, of Mobile, is charged with drug distribution. That is Class B felony, normally punishable by two to 20 years in prison upon conviction. But prosecutors said Brown’s prior convictions could make him eligible for habitual offender status, which would bump the sentencing range from 20 years to life in prison.

Thomas gave up his client’s right to a preliminary hearing, sending the fentanyl case to a grand jury. Mobile County Assistant District Attorney Lars Granade urged the judge to deny bail, arguing that the defendant poses an “extreme danger to himself and others.” He said Brown’s criminal record includes a 2011 drug distribution conviction, a 2018 conviction on charges of assaulting and shooting into a vehicle or building, and a 2020 conviction for illegal possession of a firearm.

In addition, Granade told Mobile County District Judge George Zoghby, the defendant served 18 months on a juvenile charge of sexual enticement of a child. He said the Mobile County Sheriff’s Office, during an investigation of a fatal overdose on Howells Ferry Road in September, discovered phone calls between the victim and the man charged with his death, Kaleb Daniel Harben, and between Harden and Brown – all within an hour of one another.

“This new manslaughter law just came onto the books,” he said. “They’re just now being prosecuted. And some of this could be fleshed out in court opinions, as we see appeals on these convictions. So I think it’s premature to address the distributor of the distributor when we have tools already with trafficking, which is a Class A felony, with distribution and possession with intent to distribute.
