Judge Timothy L. Brooks has ruled on Wednesday that allegations from Josh Duggar's previous molestation scandal can be used as evidence in his child pornography trial. "The Court finds, based on the Government's proffer of evidence at the hearing, that the prior acts of child molestation allegedly committed by Defendant in 2002 and 2003 against four child victims are clear and compelling," Brooks wrote in his ruling, according to"The child pornography victims, in this case, are approximately the same ages as the victims of Defendant's hands-on child-molestation offenses," the judge said.
"Accordingly, the prior act evidence is probative of Defendant's sexual interest in underage children and his propensity for exploiting young girls." Jim Bob claimed to be unable to recall key details in his testimony on Monday regarding the admissibility of the prior molestation allegations. "The Court found Mr. Duggar's selective lapse in memory to be not credible; he was obviously reluctant to testify against his son," Brooks said. Meanwhile, the defense failed in its attempt to have longtime family friend Bobye Holt's testimony removed, having claimed it fell under clergy privilege, as her husband Jim was an elder in the Duggar family church. "It is clear from her testimony—which the Court found very credible—that she was not a clergyperson at the time [Duggar] made certain disclosures to her about molesting children," judge Brookes wrote.A judge heard testimony from a Duggar family friend on Monday who claimedIn March 2003, Josh confessed to his father, Jim Bob, and mother, Michelle, along with their friends Jim and Bobye Holt that he had fondled girls. According to Bobye's testimony, Josh had admitted to the assaults at least three times to her knowledge: once the year before -- to both of his parents -- in 2003, and again in 2005 to the Holts.
