He argued at a Sept. 19 hearing that video evidence presented by the state to the grand jury doesn’t support the charges. Using cardboard as a shield, the state alleges that they removed the victim from the apartment to a vehicle in the driveway and stuffed her in the trunk. The vehicle was found two days later on a street in PatersonMcMahon argued that the video shows Ali Fisher entering the building and then leaving only a few minutes later, then speaking to a woman outside believed to be his sister. McMahon argued the video doesn’t even hint of criminal activity.

Assistant Prosecutor Jonathan Barrera countered that although the video doesn’t show what transpired inside the building, Ali Fisher’s presence at the scene, and his brief exchange with the woman outside the building, suggested that he must have known something was happening.
