A Travis County judge dismissed a lawsuit challenging Austin 's ambitious mass transit program, Project Connect . The lawsuit alleged that the city misrepresented the project's cost to voters and improperly used funds raised through a property tax increase. At the heart of the lawsuit is the contention that the city collected over $400 million in tax dollars for Project Connect that remain unspent.
Attorney Bill Aleshire, co-counsel for the plaintiffs, argued that the city failed to obtain voter approval for the project's current, scaled-down version, which he believes should necessitate a lower tax rate. He pointed to the discrepancy between the promised scope of the project and the current reality. Aleshire believes the lawsuit should have been allowed to proceed to trial and plans to appeal the judge's decision. He expressed his confidence in the appeal. However, transit advocates like Luis Osta Lugo celebrated the lawsuit's dismissal. Osta Lugo dismissed the lawsuit's claims and believes it contradicted the will of the voters. Despite the initial victory for the city and Project Connect supporters, the legal fight is far from over
