A judge granted a request by prosecutors to dismiss a felony murder charge against a man accused of driving the getaway car after a fatal shooting in 2021. The incident happened on July 22, 2021, at Berkshire Apartments on Seabreeze Court. According to police, co-conspirator Calvin Horne Jr. died after getting hit with return fire. Prosecutors sought to hold Demarcus Jamel Longmire, Jamon Kingston Merrida and Javin Rodriguez Merrida responsible for the death under a state law that allows for a felony murder charge when a death results from illegal conduct. The Mobile County District Attorney’s Office pointed to a judge’s decision to prohibit prosecutors from using a statement given by Longmire.

Defense attorney Josh Briskman told FOX10 News that the statement was the only evidence prosecutors had.Briskman said Merrida, 22, of Mobile, was a passenger in the vehicle initially and got into the driver’s seat and pulled out of the apartment complex in response to gunfire – not because he was in a criminal plot.
