A picture of Harvard Medical School from Sky View 21. A Massachusetts judge has dismissed the class action lawsuit filed against Harvard Medical School, in connection with the case of stolen human remains from the school's Anatomical Gift Program.
The lawsuit was filed shortly after the arrest of Cedric Lodge, the former morgue manager with the anatomical gift program. He is facing federal charges, accused of stealing body parts and selling them over state lines.PREVIOUS COVERAGE:An attorney who filed one of the lawsuits said it accused Harvard Medical School of violating its responsibility to protect the human remains entrusted to it. They also claim the university did not have strict enough policies for the supervision and screening of staff. In Suffolk County Superior Court Justice Kenneth Salinger's 18 page ruling he wrote the victims are, "understandably horrified that the physical remains of their loved ones may have been abused and desecrated after HMS completed its educational or research use of those remains." However, he also wrote that Harvard did not fail to act in good faith when it came to receiving and handling those donated remains, and that Harvard has qualified immunity and is not liable for the actions of Cedric Lodge while he was an employee. Justice Salinger also wrote that Massachusetts' version of the Anatomical Gift Act also protects Harvard as long as it makes a good faith effort to comply with requirements of the law.We are disappointed in the Court’s decision. These families have had to relive the trauma of losing their loved ones many times over, and we strongly believe that they deserve a day in court. We will appeal this ruling and keep fighting for them to win justice. The ruling came just a few hours after the release of a CBS 21 News documentary that followed the Harvard Medical School Anatomical Gift Program case.
