Videos and reports from Portland protests against police violence and systemic racism have shown federal agents wearing military-style camouflage uniforms arresting residents without stating the reason and taking them away in unmarked vans.
Portland Mayor Ted Wheeler, who was tear gassed on Wednesday with protesters, called the federal agents operating in the city President Trump's"personal army" and accused the administration of coordinating a strategy"to use federal troops to bolster his sagging polling data, and it is an absolute abuse of federal law enforcement officials."
U.S. District Judge Michael Mosman called the lawsuit"highly unusual," however, noting that no protesters is named as a plaintiff and that"it seeks an injunction against future conduct, which is also an extraordinary form of relief." Mosman denied a request for a temporary restraining order against the agencies, concluding that the state needed to prove"it is vindicating an interest that is specific to the state itself" were it to sue on behalf of a protester.
The Oregon Department of Justice still has other pending lawsuits against the federal agencies, with a separate judge on granting a temporary restraining order against arresting or targeting journalists and legal observers at protests.Officers from federal agencies like Customs and Border Protection and Immigration and Customs Enforcement have descended on Portland as protesters continue to march following the death of 46-year-old George Floyd on May 25.
