A federal judge denied an effort from Manhattan District Attorney Alvin Bragg to block a House Judiciary Committee subpoena of a former prosecutor.
District Judge Mary Kay Vyskocil ruled that former prosecutor Mark Pomerantz must testify before the committee in connection with the indictment of former President Donald Trump, CNN reported. She ruled that the subpoena has a"valid legislative purpose."“The subpoena was issued with a ‘valid legislative purpose’ in connection with the ‘broad’ and ‘indispensable’ congressional power to ‘conduct investigations,’" she wrote.
"It is not the role of the federal judiciary to dictate what legislation Congress may consider or how it should conduct its deliberations in that connection. Mr. Pomerantz must appear for the congressional deposition. No one is above the law,” she added. Though Vyskocil agreed that political factors were at play, she said her job is to consider the legal merits of the situation and not the political motivation on either side.“I’m talking about the subpoena. That’s what’s in front of me, not all the political rhetoric that’s been flying back and forth that’s all color, it’s all theater, but it’s not what’s in front of me,” she said.
"We look forward to his deposition," a House Judiciary Committee spokesperson said about the news of the judge's rejection of Bragg's request.
