Veterans minister Johnny Mercer has been warned he may be breaking the law by refusing to reveal the identities of whistleblowers to an independent inquirycould face jail after refusing to reveal the identities of whistleblowers in Britain’s special forces who raised concerns about allegations of murder and a cover-up.
“The simple reality at this stage is, I’m not prepared to burn them – not when, in my judgement, you are already speaking to people who have far greater knowledge of what was going on.”At the time, inquiry chairman Lord Justice Charles Haddon-Cave warned Mr Mercer him of “potentially serious legal consequences” if he continued to refuse to disclose the information.
Section 36 of the Act states that a person is guilty of an offence if they fail ‘without reasonable excuse’ to comply with a request to produce evidence. Mr Mercer said in a written statement to the inquiry last year that serving officers had informed him of allegations of war crimes regarding the UK’s most elite soldiers.The allegations include claims of SAS troops shooting Afghan detainees and unarmed men dead in suspicious circumstances. In some cases, untraceable weapons were allegedly placed on the bodies of those killed in order to suggest that they posed a threat before they were killed.
Mr Mercer has declined to comment on the issue, but a friend of the MP has said: “These sources are not people who are in any way suspects.
