The lawsuit was filed after the city withheld the promotion of an 18-year veteran of the fire department to captain July 1, 2022.
A lawsuit by the Jersey City firefighters' union over the city’s sick time and promotion policies that was dismissed by a state trial judge last year has been given new life by an appellate court panel.
The city defined “excessive” as “repeated or prolonged periods of absence or chronic undocumented absences from a recurring illness or injury, short periods of being absent on sick leave or a prolonged period of absence from duty.” In its successful motion to dismiss, the city had argued and the Hudson County Superior Court trial judge agreed that the union failed to identify a victim or victims.
The appellate panel disagreed, saying the union “is entitled to ... challenge the validity of the excessive leave policy. As to the promotion policy, we are satisfied plaintiff presented sufficient evidence of direct discrimination and retaliation to survive the dismissal motion.”
