By moving up the publication date twice, sending thousands of copies out to distributions centers and bookstores in advance , and sending scores of copies to newsrooms , a judge could reasonably conclude that it's too late to physically block the book, even aside from the First Amendment arguments.

Mary Trump's lawyers, led by Ted Boutrous, and a separate team of lawyers for the publisher, have argued that the settlement agreement is no longer valid, in part because her relatives have violated it themselves and in part because it was based on valuations of the estate she has since learned are wrong.
