Interestingly, the Treaty of Paris was not submitted by the Philippine panel when they filed the case against China when the document could have been used by us as our best evidence of ownership of that portion of the archipelago now being disputed by other countries. Article II of the Treaty of Paris signed by the US and Spain on December 10,1898 provides, and to quote a portion:
Effectively, our position to opt out of the voluntary arbitration procedure now appears to be justified.
