Resources groups, explorers and farmers say the West Australian proposal, due to start on July 1, is “shambolic” and will hold up new projects.

Mining companies and farmers have found support in an unlikely place for their push to overturn new Aboriginal cultural heritage laws in Western Australia that they claim will hold up new projects – Indigenous groups.

A major worry for landowners is that the new laws hand considerable powers to groups known as Local Aboriginal Cultural Heritage Services from July 1 even though they don’t exist in many parts of the state. Aboriginal Affairs Minister Tony Buti said, where they did not exist, native title bodies would be able to support the operation of the act, which covers activities on any parcel of land bigger than 1100 square metres.

ETNTAC, which represents native titleholders, said it preferred not to be involved in administering the new laws and hadn’t decided whether to apply to set up a Local Aboriginal Cultural Heritage Services group.
