She suggested that the prosecution's probable cause affidavit, which led to Kohberger's arrest, may have misled Latah County Magistrate Judge Megan Marshall by omitting details about the other blood samples. However, Judge Hippler expressed skepticism toward this argument, emphasizing the strong evidence linking Kohberger to the crime scene. He pointed out the presence of Kohberger's DNA on a Ka-Bar knife sheath found under Mogen's body as a crucial piece of evidence. He stated that this direct DNA connection to the sheath, found near one of the victims, significantly strengthens the probable cause for the arrest. While the defense intends to challenge the investigative genetic genealogy work used to connect Kohberger to the crime, the judge acknowledged the significance of the sheath DNA. Despite the judge's stance, the unknown DNA samples could potentially raise reasonable doubt before a jury during the trial.
