Felix Meletz Guarcas, 45, was released by the Rhode Island Department of Corrections despite an active immigration detainer, according to immigration officials.
Immigration and Customs Enforcement agents last week announced the arrest of a Guatemalan national accused of sexually abusing a child in Rhode Island.
Some authorities choose to purposefully ignore detainer requests in defiance of ICE. This complicated the agency’s mission, ERO Boston acting Field Office Director Patricia Hyde said in the press release. Guarcas was arrested by ERO agents on Nov. 20 and remains in ICE custody as he awaits a hearing with a Department of Justice immigration judge, according to the press release.
The arrest comes as several Democratic leaders are speaking out against President-elect Donald Trump’s proposed mass deportation plans. Sen. Catherine Cortez Masto, D-Nev., on Tuesday demanded that President Joe Biden use his “power” to protect immigrant families ahead of Trump’s return to the Oval Office.
