The judge ultimately allowed the man to speak with an attorney before proceeding with the hearing. The city prosecutor agreed to reduce the charges to a single misdemeanor count of driving under the influence, dismissing the other charges. The man pleaded guilty, received a $1,500 fine (which was deducted from his existing bail), and received a suspended sentence of 180 days in jail. Stucki offered words of encouragement to the man, stating that he believed his driving offense did not make him a bad person or citizen and hoped that any immigration judge would view him similarly.This was the first time in Stucki's eight years as a judge that he had witnessed ICE agents arresting someone outside of his courtroom. He was uncertain how ICE became aware of the man's immigration status and expressed a desire for greater clarity and coordination between the court system and immigration authorities.
