Andrew Garcia is accused of shooting Officer Javier Hernandez in December. Prosecutors allege Garcia's actions were deliberate and premeditated.
San Diego police Officer Javier Hernandez rounded the corner of a Mountain View apartment building, chasing a fleeing suspect down a dark path.Bullets tore through Hernandez’s right arm. He lost control of the limb. His gun — fully loaded — fell to the ground. Another bullet struck his sternum — stopped by his ballistic vest, police and prosecutors said.Thirty minutes later, while holed up in a nearby vacant townhouse, prosecutors said the suspected gunman posted to Instagram: “I killed a cop.
The incident began shortly after 12:20 a.m. when Hernandez and his partner spotted a stolen Toyota 4Runner and tried to pull it over on Main Street in Barrio Logan, police said. The driver, believed to be Garcia, sped away, kicking off a high-speed pursuit. Shortly before 1:30 a.m., the truck pulled into an apartment complex on 45th Street and Logan Avenue, and Garcia got out and ran. Police were not far behind, and Hernandez bolted after him. The officer testified that he turned around the corner of a building and found Garcia pointing a gun.
The injury was life-changing, Hernandez said Tuesday. He still experiences numbness and nerve pain, he said, and wears a brace on his right hand to help ensure he doesn’t suffer more damage. San Diego police Officer Ryan Welch was in a police helicopter hovering over the complex during the shooting. He testified Tuesday that the aircraft’s high-definition infrared camera captured some of the gunfire. The shooter could be seen dropping his weapon before hopping over a nearby fence.
