Texas' hypocrisy in its arguments against a prison guard's lawsuit have been rightly highlighted, but must not overshadow the cruelty she is alleging.
earlier this month, Salia Issa and her husband allege that TDCJ and three of her supervisors at the prison violated the Constitution and several state and federal laws. According to the lawsuit, they denied her medical care for two and a half hours during a worsening pregnancy-related emergency. As a result, she lost her child, Issa alleges.
During those excruciating two and a half hours, Issa alleges she called her supervisor several times, reiterating that she needed to go to the hospital. She was repeatedly denied, and her supervisor allegedly accused her of faking the emergency to get out of work. He said words to the effect of, “You just got here,” “You’re just lying,” and “You just want to go home,” the lawsuit claims.
It’s up to the courts whether TDCJ and Issa’s supervisors can legally be considered responsible for the stillbirth of her child. But the state has not contested the supervisor’s denial of her request for help while suffering, according to a by Magistrate Judge Susan Hightower. The fact that Issa is saying this was done to her, and that the state is not disputing it, is disturbing. All of this leaves us wondering what prison staff would have done in any other sort of medical emergency. If Issa had been experiencing heart attack symptoms or signs of a stroke, would they have stepped in to help? Their inaction doesn’t inspire confidence that they would have.
If, as Issa alleges, supervisors at TDCJ denied her the ability to get this care in the middle of an emergency, then that is indefensible.
