New housing developments surround older homes in Second Ward near a piece of property owned by the Houston Housing Authority on Tuesday, April 13, 2021, in Houston. City Council will consider Wednesday whether to approve a 400-unit affordable housing project in Second Ward on land owned by the Houston Housing Authority, which would oversee the project along with a private developer, NRP Group.

Public facility corporations are the product of the 2015 Texas legislative session. Republican Sen. Craig Estes of Wichita Falls added language to a finance statute allowing developers to receive a 100 percent property tax break in exchange. Since then they have drawn criticism for poorly defining affordability, a loophole that has been exploited by some developers whose rates on “affordable” units matched the rents for their market-rate units.

Northern emphasized that the details have yet to be set in stone — the housing authority is still negotiating the terms with developers, and the projects will go again before the board for a vote when details are finalized.
