Rep. Thomas Massie and other House Republicans introduce legislation that would allow Americans to carry guns openly in public across all states.
Representative Thomas Massie, a Republican from Kentucky, along with numerous other House Republicans, is advocating for a proposal that would mandate states to permit Americans to carry firearms in public spaces. This measure, known as the 'National Constitutional Carry Act', would prohibit states and local governments from restricting U.S. citizens from carrying firearms openly if they meet the eligibility requirements under both state and federal law.
Massie asserts that the legislation upholds the fundamental intent of the Second Amendment, which is to ensure the security of a free state, while simultaneously safeguarding individual liberties against government overreach. The proposed law explicitly states that 'No State or political subdivision of a State may impose a criminal or civil penalty on, or otherwise indirectly limit the carrying of firearms (including by imposing a financial or other barrier to entry) in public by residents or nonresidents of that State who are citizens of the United States and otherwise eligible to possess firearms under State and Federal law.' Furthermore, it declares that any statute, ordinance, regulation, custom, or practice enacted by a state or local government that criminalizes, penalizes, or discourages the open carrying of firearms by U.S. citizens who are legally permitted to possess them, shall be null and void. The act, however, would not apply to locations where firearm screening is mandated by state law, nor would it prevent private property owners from prohibiting firearms on their premises. Massie and his allies have previously championed similar proposals in the past. Notably, Massie has been a vocal proponent of gun rights, sharing a Christmas photo in 2021 where each family member held a firearm and urging Santa to bring ammunition. In 2022, he criticized the term 'Gun Violence,' arguing that it unfairly shifts blame away from the perpetrators and promotes an anti-Second Amendment agenda. Massie has also stated that socialist or communist politicians never support the right of ordinary citizens to own firearms because such regimes require greater submission to the state than armed citizens would tolerate.
