Here's Why Tyra Banks Is Suing Netflix Over The 'America's Next Top Model' Documentary

'A complete fabrication.'

According to the lawsuit, obtained by BuzzFeed, Tyra is Netflix, Netflix Music, 89 Blocks Holdings, 89's parent company EverWonder Studio, and the documentary directors, Mor Loushy and Daniel Sivan, claiming false light, defamation, breach of contract, and false endorsement.

The lawsuit alleges that only 16 minutes of a three-and-a-half-hour interview Tyra gave made it into the documentary, which she claims presented"a false and defamatory narrative unrelated to what she actually expressed.

"America's Next Top Model) because she believed viewers deserved a candid conversation about the show's legacy—its successes and its shortcomings," the lawsuit reads. "There are aspects of the show for which Ms. Banks takes accountability and she wantedtopics the interviewer could ask. "But, the lawsuit alleges,"The accountability Ms. Banks took ended up on the cutting-room floor.

""Worse, the false narrative the producers constructed—through selective editing, deliberate omission, and surgical manipulation of continuous footage—included that Ms. Banks knowingly allowed a contestant to be sexually assaulted on her show, exploited that contestant's trauma for ratings, and then could not even remember it when asked. "claimed in the doc that what was portrayed on the show as a cheating scandal was actually a sexual assault.

The lawsuit further claims that the presentation of Tyra's involvement in the situation and her remarks on it are"a complete fabrication—one that Netflix streamed to a global audience of millions.

"It adds,"On the Netflix Series, Ms. Sullivan is shown describing the event as an assault—something Ms. Banks had never heard before and was not told during her interview. " The lawsuit also takes issue with how Tyra's response to a question about Shandi was allegedly edited. According to the suit, Tyra was asked,"'You remember the story with Shandi?

' The episode shows Ms. Banks glance upward, say 'um,' and then the screen cuts to black. The implication is devastating and deliberate: that Tyra Banks cannot even remember the story of the woman who was assaulted on her show. But that was false.

The full footage of Ms. Banks’ interview reveals two things that the producers cut out and did not show viewers in Episode 1: before the upward glance, Ms. Banks nods—affirmatively, unmistakably—and immediately says, 'I do remember her story.

'"The lawsuit goes on to state that Tyra isn't bringing forth the case to dodge accountability. "She came to the interview prepared to engage with’s legacy, including its shortcomings," the suit reads,"and she did, for three and a half hours.

Viewers who came away from the Netflix Series believing Ms. Banks had not taken accountability would have known that accountability was, in fact, a major part of her interview—if only Netflix and the producers had included it in the Netflix Series. Little of it was. The producers erased much of that record and replaced it with a fabricated one.

"Tyra is seeking a jury trial and an award of damages in an amount to be determined at trial.
