It is not clear whether Phaahla had considered the contents of a letter sent to him by Motau’s lawyers on Friday and avoided a day in court by reversing Kubayi’s decision.

“In essence, the case against me is that, at the time the officials engaged in their criminal conduct, I was the accounting officer and the PFMA places the sole responsibility of the effective and transparent management of all financial and risk-related matters on the accounting officer.” He argued in papers served on the department that his suspension was likely to cost him the position he had recently assumed and was still on a 12-month probation for. Motau further argued that the kind of case he was implicated in, with a total of 23 suspects, was highly likely to go on for over 12 months.

“During the investigations, AGSA discovered financial irregularities that started around 2011, before I was even appointed HOD, and persisted until the 2015 financial year. I was duly informed by the AGSA of the details of the afore-referenced irregularities on or about April 2 2015,” Motau wrote. “I was actually a whistle-blower and I always cooperated with the relevant investigative entities,” he said.
