According to the National Prosecuting Authority , the incident caused damage calculated to be more than R500 000 so far. "With respect, cognisance must not be lost, and an armchair approach must be avoided in terms of the fact that while the gravity of counts one and two are indeed severe, both counts pertain to a single act of a truck crashing into numerous vehicles during peak-hour traffic purportedly where brake failure is suspected to be the cause of same," he says in his affidavit read out by Short.
"This poses a risk of the accused endangering other road users as the court is not in a position to suspend his driver's licence at this stage."She argued, however, the cost of travel to Durban, more than 220km away, might"cause the accused to evade trial". She added Zulu had"deliberately" refused to supply the correct details of his employer, which hindered ongoing investigations.
