Mon, March 25th 2024 at 6:24 PMThe Hays County school superintendent says a concrete truck driver is "definitely at fault," as the Department of Public Safety investigates the circumstances behind a fatal school bus crash on Friday that killed two, including a five-year-old boy.

"The concrete truck driver was definitely at fault, there’s no if's, and's, or butt's about that, and that will come out soon," Doctor Eric Wright told CBS Austin in an interview on Monday. DPS is still investigating the crash but said in a preliminary briefing that it appeared the concrete truck driver veered into the school bus's lane. Wright said the school bus driver swerving to the right to avoid a head-on collision "saved a lot of lives." No official determination has been made of liability in the crash.In a statement over the weekend, Hays CISD noted that the bus involved in the fatal accident did not have seatbelts.

Texas is one of eight states that requires school buses to have seat belts on them, according to the National Conference of State Legislatures, but Texas does carve out exceptions, as mentioned, for buses made in 2017 and before, or if the Board of Trustees of school district determines the budget does not permit purchasing a school bus with seat belts.

"For everybody to try to put blame on this one issue, when they should be putting it on the concrete truck, kind of is baffling to me," Wright said.
