Family walks away with minor injuries but faces more than $17,000 in damage
CINCINNATI - A Hamilton family is counting their blessings after a massive tree limb crushed their car while they were driving. Debris remains on the side of Park Avenue, what’s left of the limb that snapped and slammed onto Kaylie Kraemer’s car as her family drove through.
“There was no time to react. We were maybe about 5 feet from it when we saw the limb start to fall,” Kraemer said. Kraemer, her mother and her 1-year-old dog Juniper were driving when a massive tree limb came down and landed directly on their moving car.
“It landed on the hood, rolled up, shattered the windshield. It did significant damage to my car,” she said. The family walked away with scrapes and bruises. But Kraemer’s car is likely a total loss, with damage estimated at more than $17,000.
“We’ve gone through a lot of what-if’s. My mom drives a convertible. If this had happened in that car instead of my Honda Pilot, it would have been a different scenario,” Kraemer said. Racing thoughts and a pressing question remain: Who pays?
In Ohio, the person whose property is damaged is typically responsible unless the tree’s owner was negligent. Negligence hinges on whether the owner had prior knowledge of a weakened tree. The family’s insurance is sending an arborist to assess the tree’s health. The property’s landlord has not responded to a request for comment.
“I’m a medical student on a leave of absence, so I’m not made of money. I’m just hoping we can get the money together to get a new car,” Kraemer said. As Kraemer prepares for the fight ahead, she is navigating mixed emotions.
“I do feel lucky that I’m okay. I do not feel lucky that I get to be part of that very small fraction of people that had something like this happen to them,” she said. Kraemer is asking anyone who was in the area Saturday evening and has video of the incident, or knows anything about the condition of the tree, to contact her.
