Utah state Rep. Phil Lyman, who gained the support of caucusing Republicans as the party's nominee for governor, but lost that bid with the state at large.

The appeal follows the Utah Supreme Court's dismissal of Lyman's petition contesting his "being forced to a direct primary" despite winning state-GOP convention. The opinion later adds: "...as long as the Utah Republican Party seeks to be a qualified political party, it is subject to these requirements."
"These rights are circumscribed, however, when the State gives the party a role in the election process— by giving certain parties the right to have their candidates appear with party endorsement on the general-election ballot. Then the State acquires a legitimate governmental interest in ensuring the fairness of the party's nominating process, enabling it to prescribe what that process must be.
