The hearing ended on Friday without a ruling on whether the case will go to trial. Prosecutors presented evidence that they say implicates Robinson, 23, for the murder of Charlie Kirk in front of thousands of people at Utah Valley University on September 10, 2025.

The evidence included surveillance footage of Robinson's alleged movements on the day of the shooting, DNA found on a towel wrapped around the murder weapon, several alleged confessions, and bombshell testimony from his former roommate and transgender lover, Lance Twiggs. Erika sat in court each day with her in-laws, Robert and Kathryn Kirk, and became emotional throughout the proceedings, even leaving the courtroom when footage of her husband being shot was played.

Erika shared that she is still unpacking the horrific new footage of her husband's murder while speaking at the Turning Point USA event. She attended a weeklong pretrial hearing in Utah last week for Charlie Kirk's alleged assassin, Tyler Robinson, which ended on Friday without a ruling on whether the case will go to trial. On Friday, she watched intently as the zoomed-in video showed the person run across the roof, according to court reporters.

When the figure dropped to a crawl near the roof's edge, she turned and embraced Kirk's mother, who was crying. The video was not streamed and made available to the public because Judge Tony Graf ruled on Friday that exhibits will no longer be available to the media after Robinson's alleged confession note was accidentally shown. A version of the video that was not zoomed-in was shown to the court earlier in the hearing.

Graf delayed making his final decision until September 1, at which point he will rule on whether Robinson faces a murder trial and the possibility of the death penalty. Both the prosecution and defense requested time to review transcripts and submit written briefs to argue their cases, leading Graf to schedule an additional hearing to reach a final decision.

Soon after Graf concluded Friday's hearing, Erika issued a legal filing urging the judge to come to his determination 'promptly, based on the overwhelming evidence presented' by prosecutors.

'A prompt determination is imperative in the interest of justice,' Erika's attorney Jeffrey Nieman wrote in the filing. The Kirk family demanded transparency from the court and that all evidence presented be made public.

'The conclusion of the preliminary hearing marks an important step forward in the pursuit of justice for Charlie. Our family is grateful for the prayers, support, and kindness that has been extended to us, especially through these unimaginably painful and emotionally demanding proceedings,' the Kirk family said in a statement on Friday.

'As difficult as these last few days have been, it brings our family comfort to know that the world has witnessed the overwhelming evidence of what occurred to Charlie that day. 'Nothing will ever undo the loss of our beloved Charlie. As this case moves into its next phase, we pray that truth will continue to be heard through a process that is fair, transparent, and grounded in the facts. '
