Republican lawmakers had passed the legislation during the lame duck session of the Ohio General Assembly mere days after Columbus officials voted to ban the sale of flavored and menthol tobacco products in the state’s largest city, starting in 2024.

“The ease of entry into vaping and then into tobacco is brought about by the flavors,” he said, referring to both the plant and e-cigarette forms of tobacco. Senate lawmakers added the tobacco preemption into a largely unrelated tobacco bill in some of the final hours of the two-year legislative session. It passed solely with Republican backing and mostly Democratic opposition. Public health officials and the American Cancer Society mounted opposition campaigns in the roughly 36-hour window between unveiling and passage of the proposal.
