Lawmaker wants investigation of Texas Board of Pardons and Parole, which defends its actions as ‘not unusual.’
Nestor Oswaldo Hernandez has been charged with capital murder in the Saturday shooting. He was out on parole wearing an ankle monitor when he arrived at the Methodist Dallas Medical Center because his girlfriend gave birth to their child, according to an affidavit. Authorities said Hernandez, 30, entered the hospital at 11 a.m. and later opened fire, killing two medical workers.
Andrea Hardy, a spokeswoman for the state parole board, declined to comment on Anchía calling for an investigation but said it is “not unusual for offenders with aggravated offenses” to have electronic monitoring. Hernandez had served prison sentences after pleading guilty for a 2011 robbery and a 2015 robbery. In both cases, the victims of the crimes were beaten. In the 2015 case, Hernandez pleaded guilty to aggravated robbery, a first-degree felony in Texas, and was sentenced to eight years in prison.
