Legal experts have warned that Truecaller could be in breach of POPIA. Truecaller has rejected the allegations, and the Information Regulator has provided its feedback.
The Information Regulator has not received any complaints about Truecaller breaching South Africa’s Protection of Personal Information Act , the agency’s senior communication manager, Nomzamo Zondi, has told MyBroadband.might have broken the lawTruecaller asked users to upload their contacts in exchange for accessing certain features and attempted to shift the responsibility onto subscribers by stating in its terms and conditions that users must obtain the necessary consent.
Therefore, Truecaller was still the “responsible party” in Popia parlance and cannot be absolved of its responsibilities simply because it collected the information from a subscriber. Bhagat said one of the biggest misconceptions people have about Truecaller was that it required access to a user’s contacts during signup. He explained that Truecaller’s call screening feature requests access to contacts lists to determine whether the person calling is a contact.
Enhanced Search has been stripped from versions of Truecaller that are listed on Google and Apple’s official app stores to comply with their terms and conditions. “Every individual has an inherent fundamental right to know who is calling them, and we enable our users to exercise it,” a Truecaller spokesperson told MyBroadband.
