A Gary man was sentenced to one year in prison Thursday for abusing two girls over a decade apart.
Victor Davila, 73, pleaded guilty July 27 to two counts of sexual battery. He is required to register as a sex offender for the rest of his life.The two cases — charged in November 2021 and May 2023 — involve a different 7-year-old girl about 15 years apart.
Davila’s lawyer Maryam Afshar-Stewart said he had no prior sex offenses and “heavily regretted” his actions. Normally, he did not want a concurrent sentence — i.e. one sentence for two victims. However, he accepted the plea deal, partly to shield the victims from having to testify, “as lenient as it may be.”
Several months later, while wrestling he started touching her under her clothes, according to the affidavit. He told her not to tell anyone. The abuse went on for years, happening “almost every time” she went to that house. It stopped around New Year’s Day 2019 when she elbowed him in the kidneys.
