A key piece of the puzzle is Deere's software tool, 'Service ADVISOR,' which is exclusively accessible to authorized dealers who pay a premium. The FTC argues that this tool is essential for comprehensive equipment repairs, effectively barring farmers and independent repair providers from performing these tasks themselves. Furthermore, the FTC alleges that authorized dealers often prioritize Deere-branded parts over more affordable generic alternatives during repairs, contributing to Deere's profits. The FTC Chair, Lina Khan, stated in a news release, 'Illegal repair restrictions can be devastating for farmers, who rely on affordable and timely repairs to harvest their crops and earn their income.' She emphasized that the FTC is aiming to empower farmers across the nation by ensuring they have the freedom to repair their equipment independently or choose repair shops of their preference. Khan believes this will lead to lower costs, prevent costly delays, and foster fair competition among independent repair shops. The lawsuit seeks to make 'Service ADVISOR' and other critical repair resources accessible to all Deere customers and independent repair providers. The FTC points to other manufacturers in the trucking and auto industries who readily provide the necessary information for generic repair tool developers, highlighting Deere's perceived deviation from this standard practice. In response to the lawsuit, Deere's Vice President of Aftermarket and Customer Support, Denver Caldwell, expressed disappointment, stating that the lawsuit was 'meritless' and filed on the eve of a new administration's transition.
