A former tutor at Project Fashion Ltd , a fashion academy for children and teenagers, has brought a complaint under the Unfair Dismissal s Act 1977 alleging constructive dismissal. The tutor, identified as Darcy, claims her concerns about child safety and inadequate training were dismissed by the company's founder, Paul Keeley .
The WRC (Workplace Relations Commission) heard the case, where Darcy detailed a work environment she described as highly stressful and unsafe, leading to her eventual resignation. She expressed worries about the age of the children enrolled, citing the risks associated with operating sewing machines, specifically the lack of foot reach for the control pedal in some instances. Darcy recalled an incident where she had to manually remove a needle from a sewing machine to free a young girl whose finger had been impaled, highlighting her lack of first aid certification and the subsequent need for the child to be taken to the hospital. She stated that her decision to continue working in this environment was driven by the need to support her family as a single mother. Her concerns about child safety were repeatedly brought up with Paul Keeley, particularly regarding children tripping over extension leads and the potential for injuries from the machines. Darcy said that on numerous occasions she spoke to Keeley about child safety and lack of first aid training. Paul Keeley stated that he didn't remember the talks about first aid
