A jury will determine the punishment for Jesus San Miguel, who was found guilty of criminally negligent homicide in the stabbing death of Joshua Kinnaman.
A jury has begun hearing testimony in the punishment phase of the retrial for a former John Jay High School student convicted of stabbing another student to death. Jesus San Miguel, 20, was found guilty in October for the fatal stabbing of Joshua Kinnaman, 18, on April 4, 2023. The jury convicted San Miguel of criminally negligent homicide — a lesser offense from the original murder charge.
The presiding judge in the case, Judge Velia Meza, declared a mistrial after the jurors said they could not agree on San Miguel's punishment. A new jury that was chosen on Monday will listen to testimony Tuesday to decide on punishment. If San Miguel, who was 18 at the time of the incident, had been convicted of murder, he would have faced up to life in prison. Criminally negligent homicide is a state jail felony punishable by up to two years in a state jail facility. However, because San Miguel was accused of using a deadly weapon during the crime, the charge was enhanced to a third-degree felony offense. He faces two to 10 years in prison. Bexar County prosecutor Raul Jordan said San Miguel was armed with a knife when he walked into La Fiesta de Jalisco, a Mexican restaurant across the street from John Jay High School. There, he was challenged by Kinnaman to a fight that started over 'trash talk' between the two, Jordan said. As the two fought in the parking lot of the restaurant, San Miguel stabbed Kinnaman in the torso with a knife. San Miguel fled the scene, and Kinnaman ran inside the restaurant seeking help. He was taken by ambulance to a hospital, where he later died. 'Jesus San Miguel brought a knife to a fist fight,' Jordan said. 'Turning what should have been a school yard scrap between two friends who had known each other since middle school into a deadly incident where one young man lost his life.'
