At issue in the proceedings is an email, allegedly sent by Reiter on March 13, 2020, which the former health minister testified was, in his understanding, a delegation of his authority toThe email was sent, Reiter told Crown prosecutor Dana Brule, to satisfy a requirement to have something in writing. When asked by the prosecutor whether he had any concerns with the procedure used, Reiter’s answer was straightforward.
In contention is what area of provincial law would allow the actions taken by Reiter and subsequently by Shahab. Following that decision, Brule said the Crown had closed its case, and Anderson said the defence would call no evidence.
Anderson’s position was, effectively, that the applicable law does not permit restrictions on the size of gatherings or the delegation of authority to Shahab, as it was alleged to have occurred.
