Under the proposed settlement, any customer of FirstEnergy subsidiaries Ohio Edison, the Cleveland Electric Illuminating Co., or Toledo Edison who paid any costs related to the HB6 scandal between 1/1/2020 & 6/22/2022 would be eligible to receive money.

If the settlement is approved, all eligible FirstEnergy customers would automatically receive their share of the money unless they notify the settlement administrator in writing by Oct. 5 at:There’s a catch for people who don’t opt out: under the terms of the proposed settlement, anyone who accepts money from it cannot make future legal claims against FirstEnergy, ex-FirstEnergy subsidiary Energy Harbor, or other parties in the case that involve HB 6 or the allegations made in this case.

FirstEnergy customers also have the option of objecting to the proposed settlement by Oct. 5, either in writing or by arranging to speak in person during a court hearing . Those who file such objections would not opt out or give up their share of any settlement money.and $11.5 million from Energy Harbor, a former subsidiary of FirstEnergy.

The class-action settlement, if approved, would resolve four lawsuits filed by FirstEnergy customers in the wake of the HB6 scandal, in which FirstEnergy admitted to paying $60 million in bribes to dark-money groups overseen by then-Ohio House Speaker Larry Householder to secure the passage of HB6 andHB6 gave a $1 billion-plus ratepayer bailout,, to two Northern Ohio nuclear power plants owned by Energy Harbor then a part of FirstEnergy), as well as other policies that benefitted FirstEnergy.

Householder, who has maintained his innocence, is set to go to trial next year on a federal corruption charge. Three other co-defendants have already pleaded guilty to their roles in the scandal. FirstEnergy agreed to pay a $230 million fine as part of a deferred prosecution agreement announced in July 2021; so far, none of the other defendants in the class-action lawsuit have been accused of any crime.
