Federal prosecutors are investigating whether to file charges against Luigi Mangione, the suspected killer of UnitedHealthcare CEO Brian Thompson. Two sources familiar with the matter told NBC News that if federal charges are filed, the New York state murder case against Mangione would take priority.
Mangione, 26, was indicted Tuesday on first-degree murder and other charges in the targeted killing of Thompson, who authorities said was shot from behind as he walked on a Manhattan sidewalk on December 4th. New York police said Mangione targeted Thompson, possibly because of the size of the private health insurance company he led. UnitedHealthcare is the largest private health insurer in the United States. Mangione was indicted on a charge of first-degree murder in furtherance of terrorism, in addition to counts of second-degree murder and other counts. In New York, a first-degree murder charge requires a special circumstance beyond intent, like the killing of a witness, a murder-for-hire, the killing of a police officer, or a killing in furtherance of terrorism. Manhattan District Attorney Alvin Bragg said Tuesday that the ambush killing of Thompson was 'intended to cause shock and attention and intimidation.' Mangione, wearing a hooded jacket and a mask, waited for nearly an hour near a hotel for Thompson to arrive, and then shot him from behind with a 9mm handgun equipped with a suppressor at around 6:45 a.m., Bragg said. Mangione was arrested in Altoona, Pennsylvania, on December 9th after being recognized from surveillance photos distributed by New York police and the FBI after the killing. He is currently being held in custody in Pennsylvania and has so far contested extradition to New York. A hearing is scheduled for Thursday. A spokesperson for the U.S. Attorney's Office for the Southern District of New York, which is the federal prosecutor's office in Manhattan, declined to comment
