A federal judge has halted the U.S. Department of Health and Human Services ( HHS ) from sharing personal data of Medicaid enrollees with federal immigration officials. The temporary injunction, issued by Judge Vince Chhabria in California, affects 20 states, including California, Arizona, Washington, and New York. The judge's decision comes in response to a lawsuit filed by 20 states alleging that the HHS violated federal privacy laws by sharing this sensitive information.
\ Chhabria argued that using Medicaid data for immigration enforcement jeopardizes the program's effectiveness. He stated in his ruling that using CMS data for immigration enforcement 'threatens to significantly disrupt the operation of Medicaid—a program that Congress has deemed critical for the provision of health coverage to the nation’s most vulnerable residents.' \The HHS initially provided personal data of millions of Medicaid enrollees in a few states in June. Subsequently, in July, the Centers for Medicare and Medicaid Services (CMS) entered into an agreement granting the Department of Homeland Security (DHS) daily access to the personal information of all 79 million Medicaid beneficiaries nationwide, including Social Security numbers and home addresses. These agreements were not publicly disclosed. This data sharing initiative is part of a broader strategy by the Trump administration to bolster the DHS's capabilities to track and apprehend migrants. In a related case, a federal judge earlier this year blocked the Internal Revenue Service from sharing tax information of immigrants with Immigration and Customs Enforcement (ICE). The program restricts enrollment for those lacking legal status in the U.S, but federal law mandates states to offer emergency Medicaid to all, including non-U.S. citizens, for life-saving emergency services
