A federal judge has blocked the Department of Defense's latest attempt to ban transgender individuals from serving in the military. Judge Ana Reyes, a Biden appointee, denied the government's motion to dissolve the injunction preventing the military from denying transgender individuals the right to enlist. The Department of Justice has since filed an appeal with the U.S. Court of Appeal for the District of Columbia.
\Reyes presided over a hearing on March 21st, where she also requested the Department of Defense delay its original March 26th deadline to implement the policy. She acknowledged the new Military Department Identification Guidance (MIDI Guidance) issued March 21st but maintained that the Defense's argument, that the policy is based on mediccal condition and not discriminatory, is not new. \The Trump administration had argued that the policy doesn't ban transgender people outright but instead focuses on 'gender dysphoria – a medical condition – and does not discriminate against trans-identifying persons as a class.' They requested the court to either dissolve the injunction or stay it pending appeal. Judge Reyes stated that gender dysphoria is different from other medical conditions, as it uniquely affects transgender individuals. She pointed out that the policy, aimed at regulating gender dysphoria, ultimately targets transgender people. \Reyes's decision comes amidst a broader legal battle over transgender rights. The Supreme Court is currently reviewing a case regarding the equal protection clause and its application to states allowing medical providers to administer puberty blockers and hormones to minors transitioning genders.
