A federal court ruled Thursday against President Donald Trump’s new global tariffs. The tariffs were imposed after the administration’s earlier A three-judge panel of the Court of International Trade in New York found the 10% global tariffs were illegal after The court ruled 2-1 that Trump overstepped the tariff authority granted by Congress. The tariffs are “invalid” and “unauthorized by law,” the majority wrote.

The ruling follows a February Supreme Court decision that struck down the “Liberation Day” tariffs Trump imposed last year on nearly every country using the 1977 International Emergency Economic Powers Act . The new tariffs were invoked under Section 122 of the Trade Act of 1974 and were set to expire July 24.

The law allows tariffs of up to 15% for up to 150 days in response to “large and serious” U.S. balance-of-payments deficits or other major international payment problems. The court’s decision directly blocks tariff collection from three plaintiffs — the state of Washington and two businesses, spice company Burlap & Barrel and toy company Basic Fun!

“It’s not clear” whether other businesses will have to continue paying the tariffs, said Jeffrey Schwab of the Liberty Justice Center, which represented the companies. As of April 26, more than 75,000 businesses had applied for refunds through U.S. Customs and Border Protection. More than 47,000 claims were deemed properly filed, and roughly 1.7 million tariff payments are being refunded.
