A federal appeals court has overturned lower court rulings that prevented Pennsylvania from accessing funds from a state-chartered medical malpractice insurer. The court ruled that the state government, as the creator and sole beneficiary of the insurer, has the authority to amend or dissolve it as it sees fit.
