When he was convicted at the High Court in Aberdeen in March 2018, there was an"agreed narrative" between the Crown prosecutors and the defence over what happened that night. The defence lawyer also referenced a statement taken from a previous partner of Ms Miazek that outlined"erotic sexual asphyxiation was something she was interested in", although the couple never practised it.
He questions how someone who has strangled a person to death is allowed to say the victim consented without any proof.
