Suit alleges agency’s failure to create safe conditions in its stations led to wrongful death
The family of a Daly City woman who was fatally pushed into the path of a BART train in San Francisco last year is suing the agency for wrongful death and elder abuse, alleging that the transit operator’s failure to address riders’ safety needs led to Corazon Dandan’s passing.
“We just want change,” said Dr. Alvin Dandan, Corazon’s nephew and estate administrator. “To make sure that whoever’s family member is going to take that ride, whether in the morning, in the evening, especially females and people of color, we want it to be a very safe place to be.” Nanci Nishimura, a family attorney and partner at Cotchett, Pitre and McCarthy, the law firm which brought the suit against BART, said Dandan’s death was “just one example” of the unsafe conditions hampering the agency.
