When a man spotted Brooks near a gas station with the stolen goods and in a different set of clothes, he contacted authorities. Hardin responded and an altercation ensued. In the video, Brooks is seen grabbing the sergeant's Taser, but the family contends this was an act of self defense. "The sheriff said that was the first time he saw any type of video about this incident," he said."We think the sheriff should've watched this video before trotting it out to the family to placate us, but instead, I don't think he found it to be important."
The Sheriff's Office is not able to comment much on the suit because of the pending investigations and litigation, spokesman Jason Spencer told the Chronicle. The sergeant is on administrative duty and homicide investigators have given their report to the District Attorney's Office so it can be presented to a grand jury, a standard procedure for all officer-involved shootings, he said.
